These Terms apply to the website at https://moatkit.com, the MoatKit mobile app for iOS and Android, and related pre-launch, purchase, account, and support flows.
2. The service
MoatKit provides founder education, business models, stories, insights, playbooks, tasks, habits, journals, and other tools for entrepreneurs and business operators.
MoatKit content is educational and informational. It is not legal, tax, accounting, investment, financial, medical, or other regulated professional advice. You are responsible for evaluating any business decision in your own context and consulting qualified professionals where appropriate.
Features may change during pre-launch, beta, and regular product development. We may add, remove, redesign, or limit features when needed to improve the product, comply with law, maintain security, or keep the service commercially viable.
3. Accounts and access
You may need an account to use synced features, premium content, subscriptions, or the Founders' Charter. You are responsible for keeping your account credentials and devices secure.
Access is personal to you unless we explicitly agree otherwise in writing. You may use MoatKit for your own business and professional work, but you may not share, resell, scrape, copy, or redistribute the paid content as a competing product, course, database, or public content library.
4. Plans, billing, and trials
App store purchases are subject to Apple or Google terms in addition to these Terms. If a store confirmation screen conflicts with website marketing copy, the store confirmation screen controls the purchase.
Taxes, VAT, payment method checks, fraud checks, invoices, store receipts, and chargebacks are handled by the relevant payment provider or merchant of record.
5. Refunds and withdrawal rights
For Apple App Store and Google Play purchases, cancellation and refund requests must normally be handled through the relevant store account or support channel.
For Founders' Charter purchases, contact [email protected] or use the Lemon Squeezy support flow. EU consumers may have a statutory 14-day withdrawal right for distance contracts. For digital services or digital content, the law can allow this right to expire early only where the required express consent and acknowledgement are obtained before performance begins.
The Founders' Charter launch guarantee is separate from statutory rights: if MoatKit has not shipped by Aug 31, 2026, Charter purchases are intended to be refunded under the launch guarantee described on the website.
Nothing in these Terms limits mandatory consumer rights, statutory warranty rights, or rights that cannot legally be excluded.
6. Widerrufsbelehrung (Right of withdrawal)

Folgen des Widerrufs
Wenn Sie diesen Vertrag widerrufen, haben wir Ihnen alle Zahlungen, die wir von Ihnen erhalten haben, einschließlich der Lieferkosten (mit Ausnahme der zusätzlichen Kosten, die sich daraus ergeben, dass Sie eine andere Art der Lieferung als die von uns angebotene, günstigste Standardlieferung gewählt haben), unverzüglich und spätestens binnen vierzehn Tagen ab dem Tag zurückzuzahlen, an dem die Mitteilung über Ihren Widerruf dieses Vertrags bei uns eingegangen ist. Für diese Rückzahlung verwenden wir dasselbe Zahlungsmittel, das Sie bei der ursprünglichen Transaktion eingesetzt haben, es sei denn, mit Ihnen wurde ausdrücklich etwas anderes vereinbart; in keinem Fall werden Ihnen wegen dieser Rückzahlung Entgelte berechnet.
Haben Sie verlangt, dass die Dienstleistungen während der Widerrufsfrist beginnen sollen, so haben Sie uns einen angemessenen Betrag zu zahlen, der dem Anteil der bis zu dem Zeitpunkt, zu dem Sie uns von der Ausübung des Widerrufsrechts hinsichtlich dieses Vertrags unterrichten, bereits erbrachten Dienstleistungen im Vergleich zum Gesamtumfang der im Vertrag vorgesehenen Dienstleistungen entspricht.

7. Content and intellectual property
MoatKit, the app design, text, lessons, models, stories, frameworks, playbooks, screenshots, brand assets, and software are protected by intellectual property rights. You receive a limited, non-exclusive, non-transferable right to use MoatKit for your own learning and business operations.
Your notes, journal entries, tasks, habits, profile inputs, feedback, and community posts remain yours. By submitting content to MoatKit, you allow us to host, process, display, and sync that content as needed to provide the service.
If you submit feedback, ideas, or suggestions, you allow us to use them to improve MoatKit without compensation or restriction, while respecting your privacy rights.
8. Acceptable use
- Do not violate law, infringe third-party rights, or upload unlawful, harmful, or misleading content.
- Do not attempt to bypass paywalls, access controls, rate limits, security controls, or entitlement checks.
- Do not reverse engineer, scrape, bulk export, resell, sublicense, or redistribute MoatKit content except where law allows it.
- Do not use MoatKit to generate spam, phishing, fraud, illegal advice, or deceptive business claims.
- Do not interfere with the service, infrastructure, app stores, payment providers, or other users.
We may suspend or terminate access if we reasonably believe these rules are breached, if payment is reversed or fraudulent, or if continued access would create legal, security, or operational risk.
9. Privacy
Personal data is handled under the Privacy Policy. The app may use local storage, cloud sync, subscriptions, diagnostics, notifications, and analytics as described there.
10. Availability and changes
We aim to keep MoatKit available and useful, but no digital service can guarantee uninterrupted access. Maintenance, app store review, provider outages, security events, or legal requirements may affect availability.
We may update these Terms. Material changes will be reflected by updating the date above. If required by law or by the nature of the change, we will provide additional notice.
11. Warranty and liability
MoatKit is provided with reasonable care, but business outcomes are not guaranteed. You remain responsible for your decisions, implementation, compliance, finances, contracts, hiring, pricing, and market choices.
Nothing in these Terms excludes or limits liability for intent, gross negligence, injury to life, body, or health, statutory product liability, mandatory consumer rights, or other liability that cannot legally be limited.
For simple negligence, liability is limited to breaches of essential contractual obligations and to typical foreseeable damages, to the extent legally permitted.
12. Governing law and disputes
German law applies, without limiting mandatory consumer protection rules that apply in your country of residence.
If you are a merchant, public-law entity, or special public-law fund, the place of jurisdiction is the operator's place of establishment to the extent legally permitted. Consumers retain the mandatory jurisdiction protections available under applicable law.
We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board. The former EU Online Dispute Resolution platform was discontinued on 20 July 2025.
